Definitions
"Designated Appliance(s)" means residential heating, ventilation, and/or air conditioning equipment covered under the Service Plan, including but not limited to furnaces, boilers, water heaters, air handlers, air conditioning/heat pumps and fireplaces, powered by heating oil, propane or natural gas, as determined and approved by McDougall Energy.
"Eligible Customer" means a McDougall Energy residential customer who satisfies all the eligibility requirements set out in Section 2 of these Terms and Conditions, including residing at a qualifying Premises within the eligible regions of Ontario and be enrolled in a valid Service Plan for one or more Designated Appliance(s).
“McDougall Energy” means McDougall Energy Inc.
"Offer" means the promotional discount of fifteen percent (15%) off the cost of the base rate for annual maintenance service under an applicable Service Plan, provided Eligible Customers who enroll in and maintain a valid Service Plan for one or more Designated Appliance(s), subject to these Terms and Conditions.
"Premises" means the residential property in which the Designated Appliances are installed and covered under a valid Service Plan.
"Service Plan" means McDougall Energy's annual renewing service coverage plan for residential HVAC equipment, which includes scheduled maintenance, inspections, and/or other applicable services for Designated Appliances, as further described in the Service Plan.
1. Offer
McDougall Energy shall provide the Offer to Eligible Customers, subject to the eligibility criteria set out in Section 2 and additional terms in Sections 3 and 4 herein.
2. Eligibility
To qualify as an Eligible Customer under this Offer, a customer must:
a) Reside at a Premises located in an eligible region of Ontario, as outlined in Section 3;
b) Be actively enrolled in a Service Plan with McDougall Energy for at least one (1) Designated Appliance; and
c) For oil and propane appliances, be an active McDougall Energy fuel customer. For natural gas, customers must reside at the Premises.
3. Geographic Region
a) This Offer is currently available to customers residing in the municipality of Goderich and in the surrounding area, subject to geographic eligibility as determined by McDougall Energy. Customers located in the surrounding area must contact McDougall Energy at hvac@mcdougallenergy.com to confirm whether their specific location qualifies for the Offer.
b) McDougall Energy reserves the right, at its sole discretion, to change, modify, expand or restrict the the list of eligible regions at any time.
c) Customer inquiries regarding the eligible regions of Ontario shall be directed to hvac@mcdougallenergy.com.
4. Additional Conditions
The following additional conditions apply to this Offer:
a) Eligible Customers will be invoiced for the discounted maintenance service in the month the maintenance occurs.
b) The Offer is non-transferrable and may only be used by the original Eligible Customer.
c) Eligible Customers must provide supporting documentation upon request to verify compliance with the eligibility requirements which may include proof of address, proof of active fuel account, or proof of enrolment in a Service Plan. McDougall Energy reserves the right to withhold the Offer if such documentation is not provided.
d) The Offer may not be changed, upgraded, combined, or substituted with any other promotion.
e) McDougall Energy reserves the right to suspend, disqualify, limit, or revoke the Offer to any person or customer who is found or reasonably believed to be manipulating, misusing, or otherwise abusing the Offer or its intended purpose.
f) McDougall Energy may modify or terminate this Offer or these Terms and Conditions at any time without prior notice. The most current version of these Terms and Conditions will be available at mcdougallenergy.com, and continued participation in the Offer constitutes acceptance of any updates.
g) In the event of any conflict between these Terms and Conditions and any other document, brochure, or promotional material related to the Offer, these Terms and Conditions shall prevail.
h) These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.
i) McDougall Energy shall not be liable for any indirect, incidental, or consequential damages arising out of or related to this Offer, including any failure by the customer to receive or benefit from the Offer due to incomplete or inaccurate information.
j) The Offer applies only to the base rate associated with the type of Designated Appliance(s) covered under the applicable Service Plan. The discount does not apply to any additional charges that may be incurred beyond thebase rate, including but not limited to additional labour, extensive cleaning, or parts replacement required due to the condition of the Designated Appliance(s).
